Falling asleep while serving as a sentinel has always been a Capital Crime under the Articles of War, adapted from the British version.
It still is.
The current edition of the Uniform Code of Military Justice, signed into law in 2002, gives death as the Maximum Penalty for a sentinel falling asleep while on guard duty during time of war.
Court Martials have always had the authority to assign lesser penalties.
